OTA’s Ministry of Finance Policy Brief on Facility Insurance Reform

OTA has developed a policy brief outlining key gaps in the current Facility Association regime, which proposes solutions to strengthen safety, accountability, and fairness within Ontario’s commercial trucking insurance framework. 

To support this work, OTA established a dedicated working group of carrier members with expertise in fleet operations, safety, compliance, and insurance. The working group met over several weeks to review current challenges within the Facility Association system, identify areas requiring reform, and help develop practical recommendations for consideration by government and regulators. 

At the 2026 OTA spring board meeting, the Board requested that OTA provide the Ministry of Finance with a list of solutions, which OTA has since shared with the Ministry and is awaiting a response. 

OTA’s recommendations focus on ensuring Facility is used as a transitional mechanism, not a long-term insurance solution for high-risk commercial fleets. Key asks include implementing a “sunset clause” that would establish a 24-month limit for commercial fleets in Facility, requiring stronger underwriting tied to driver history and fleet-level safety practices; incorporating MTO and FMCSA safety performance into risk assessments; and requiring more robust pre-quote risk inspections.

OTA also recommended that Facility track corporate ownership to prevent “chameleon carrier” behaviour and remove the ability for commercial trucking companies to opt out of Direct Compensation for Property Damage coverage.

OTA will continue to engage the Ministry of Finance, FSRA, and other relevant stakeholders to advance reforms that better align commercial insurance practices with public safety, responsible fleet management, and fair competition across Ontario’s trucking sector.
